Billerica Conservation Commission cancels hearings The Lowell Sun Article Last Updated: 06/28/2007 12:19:41 PM EDT BILLERICA -- Last night's scheduled Conservation Commission meeting was canceled because the board was unable to reach a quorum. The commission was facing a full agenda, with six public hearings as well as other business, including the continuance of a hearing for the controversial Village Crossing townhouse development on Treble Cove Road. Village Crossing, a 61-unit, over-55 townhouse development proposed by Birchwood Development, was denied by the Planning Board in January amid strong neighborhood traffic concerns. In March, attorneys for the developer, Arturo Gutierrez filed an appeal with the state's Land Court, stating that the board's decision was "arbitrary, capricious, legally untenable and exceeded its authority, and therefore should be annulled." The appeal has not yet been heard. Conservation Commission Chairman Joanne Giovino did not return a call to her home last night. It is unclear when the hearings scheduled for last night will be rescheduled.
