Let me clear up the confusion on pits and wether they can be blocked off or not . This will cover areas like the back of creeks or discharge canals as well . If the landowner owns the land under the water - covered by a Kings Grant - then they can block off access by ANY entry . This covers ALL water tidal or not due to the fact that the Kings Grant covers to mean low tide . This is what allows Va. Power to block access to the their discharge canal much the same way as the folks that own the marsh on both sides of Greys Creek . Just because you can float a boat into it doesn't make it legal to do so .
