You could have fought this..without a will, all of his heirs would have been entitled to a certain percentage through probate. If he had a will that didn't include all of his current heirs, that would have been another story. People don't like to think about dying... understandably. The problem is that if they leave more than the clothes on their back and people who think they are entitled, someone is bound to get short changed. A friend was in a similar situation..her husband never changed the executor on his will or made provisions for her. It was his brother, who he would do the right thing. Even her home wound up in jeopardy as a result. Another incidence between a brother and sister..the sister was the executor but she felt her brother wasn't responsible enough to handle money..so as long as I knew her, she never turned over what her brother was due, but doled out a pittance here and there. As far as I knew there was no reasonable reason to withhold his share. I could relate dozens of similar inequities.
