Re: The big one and the west coast......Elle
I made a lot of phone calls, i.e., to the bank where he said the will was located, found out the box had been closed after he died. I called the courts and legal societies for general information, also an attorney recommended by the bar association. Nothing proved of any value. I was given the website to all the Oregon laws, and read, too, about who is supposed to get what when someone dies intestate. The court told me his will did not go through probate (it doesn't necessarily have to), and there was no record of any will being filed with them (it doesn't have to be.) Under those conditions, how is anyone to know anything? I do believe that their property is joint, which means survivorship. That would preclude anyone else from inheriting it. However.....I'm sure in his will, which I believe she disposed of, mention was made of what was to go to the children as far as personal effects and possible financial bequests. There is no way to prove any of that without the will, and I'm sure she shredded the hell out of it, or that it went up her chimney in smoke.
